What is a DUI Defense Investigator and what do they do?
Simply put, a DUI Defense Investigator is a private investigator who works for criminal defense attorneys and on behalf of the defense attorney’s client to review, analyze, and evaluate all aspects of a traffic stop or accident which resulted in an arrest and charge of DUI. In essence, it is the investigator’s job to report on all aspects of the stop, field sobriety test (roadside gymnastics), chemical testing, and arrest. Many individuals who are arrested and charged with DUI do not fully realize the long-term impact that such a charge can have. Penalties can range from hefty fines, loss of driving privileges, installation of an ignition interlock device, and all the way up to jail or prison. On top of that, many employers are reluctant to hire or continue to employ somebody who has been convicted of a DUI which means the loss of your job and difficulty in finding new and gainful employment, in addition to the above-mentioned fines and penalties, could be a very real possibility if you are convicted of a DUI. As you can see, a DUI is not something which should be taken lightly. What sort of training does your DUI Defense Investigator have?
Our staff investigator is both a licensed private investigator as well as the owner of a licensed private investigative agency. Prior to becoming a private investigator, he worked for the State of Oklahoma as a Medicolegal Death Investigator. He has conducted nearly four hundred scene investigations and has completed countless hours of formal and on-the-job training on the techniques of investigations. As it pertains specifically to DUI’s, our investigator has completed National Highway Traffic Safety Administration (NHTSA) recognized training on DUI Detection and Standardized Field Sobriety Testing (SFST). The training he has undergone is the exact same training that all law enforcement officers in the country receive. Because of this fact, he has met the requirements under Title 47 Section 902.N of Oklahoma Statutes to testify as the defense’s expert and offer his opinion.
“47 O.S. § 902.N – If qualified by knowledge, skill, experience, training or education, a witness shall be allowed to testify in the form of an opinion or otherwise solely on the issue of impairment, but not on the issue of specific alcohol concentration level, relating to the following:
- The results of any standardized field sobriety test including, but not limited to, the horizontal gaze nystagmus (HGN) test administered by a person who has completed training in standardized field sobriety testing; or
- Whether a person was under the influence of one or more impairing substances and the category of such impairing substance or substances. A witness who has received training and holds a current certification as a drug recognition expert shall be qualified to give the testimony in any case in which such testimony may be relevant.”
In addition to his training on SFST, he has also completed training on the proper use and maintenance of preliminary breath testing devices, also known as PBT’s, and has attended the only courses offered in Oklahoma which specifically cover conducting investigations into DUI stops and arrests. Our investigator is an affiliate member of the Oklahoma Criminal Defense Lawyers Association and is also one of only three investigators, in the country, who has been granted membership in the American Association of Premier DUI Attorneys.
What information does a DUI Defense Investigator obtain and review?
The following is a list of items which are most often obtained and reviewed by a DUI Investigator:
- Arresting officer’s dash camera video/audio
- Arresting officer’s body camera video/audio
- Exterior security camera recordings made by any nearby private business
- Arresting Officer’s Probable Cause Affidavit
- Arresting Officer’s Incident Report
- Arresting Officer’s Affidavit and Notice of Revocation
- Training records of the officer who administered SFST’s and any chemical tests.
- All reports made by any backing officer
- All dash and body camera recordings from all backing officers
- Oklahoma Board of Tests breath-analysis machine maintenance logs.
